1. Welcome to Squishyville

These Terms of Service ("Terms") govern your access to and use of squishyville.com (the "Site") and any products purchased through the Site. Squishyville is operated by Yuan Shi, a sole proprietor based in the United States ("we", "us", or "our").

By accessing the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to place an order. By using the Site, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding contract;
• Any information you provide is truthful, accurate, and complete;
• You will use the Site only for personal, non-commercial purposes.

Minors under 18 may use the Site only with the active involvement of a parent or legal guardian, who agrees to be responsible for the minor's conduct.

3. Our Products

Squishyville sells slow-rising squishy toys ("squishies") — soft sensory and stress-relief items made from PU foam or similar materials, designed for tactile play and relaxation. Our squishies are appreciated by both children and adults, but our products are not certified as children's toys under the Consumer Product Safety Improvement Act (CPSIA) and are not marketed specifically to children under 13.

4. Orders & Payment

Order acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion, including for reasons such as suspected fraud, inventory error, or pricing mistakes. If we cancel your order, you will receive a full refund.

Pricing

All prices are in US Dollars (USD) and exclude applicable sales tax. Prices may change without notice, but changes will not affect orders already accepted by us. We make every effort to ensure pricing accuracy; if a pricing error is discovered after order placement, we may cancel the order and issue a full refund.

Payment

Payments are processed securely by Stripe, Inc. We do not store your card details on our servers. By submitting payment information, you authorize us (via Stripe) to charge your payment method for the full order amount.

5. Shipping

We currently ship only within the United States (including Hawaii and Alaska, with possible additional charges). Full details, transit times, and order processing times are described in our Shipping Policy.

6. Returns & Refunds

We accept returns only for products that arrive damaged or are sent in error. Full details, including the 30-day reporting window and the process for reporting damage, are described in our Refund Policy.

By placing an order, you acknowledge and agree to our return policy, including that change-of-mind returns are not accepted.

7. Account Registration

You may create an account to track orders, save addresses, and access your purchase history. You are responsible for:

• Keeping your account credentials confidential;
• All activity that occurs under your account;
• Notifying us immediately of any unauthorized access.

We may suspend or terminate accounts at our discretion, including for violations of these Terms, fraudulent activity, or extended periods of inactivity.

8. Intellectual Property

All content on the Site — including product designs, illustrations, text, photographs, the "Squishyville" name and logo, and related trademarks — is owned by Yuan Shi or our licensors and is protected by U.S. and international copyright and trademark laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission, except for limited personal, non-commercial use (e.g., sharing a product link with a friend).

9. Prohibited Conduct

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to our systems or other users' accounts;
• Use automated tools (bots, scrapers, etc.) to access the Site without our consent;
• Interfere with or disrupt the operation of the Site;
• Submit false information, fraudulent payment details, or stolen card data;
• Resell products purchased from the Site without our written consent.

10. Disclaimers

The Site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive to display products accurately, colors, textures, and sizes shown on the Site may vary slightly due to monitor settings, photography lighting, or batch variation in handmade items. Such minor variations do not constitute a defect.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall Yuan Shi or Squishyville be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products, including but not limited to lost profits, lost data, or business interruption.

Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim, or USD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Yuan Shi and Squishyville from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site or our products.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Any dispute arising from these Terms or your use of the Site shall be resolved as follows:

1. Informal resolution: Contact us first at orders@squishyville.com. We will work in good faith to resolve the issue within 30 days.
2. Binding arbitration: If informal resolution fails, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive any right to participate in class actions.
3. Exception: Small claims court actions and intellectual property disputes may be filed in court.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
